1.Introduction.
“Cultural tours s.p.c”is a private advertizing company,operating under the trade name “OneDayLocal”( henceforth referred as “we or”us” or”OneDayLocal”), with its head offices located in Vari, Athens zaloggou2 str (Vat nr….). We operate a marketplace platform that connects users ( henceforth “byuers”)and independent tour guides,tour escorts and certified tour guides(henceforth ” suppliers”). Our platform allows independent tour guides, tour escorts and certified tour guides to market their tours and travelers to find and book guided tours, post reviews, and process payments. We do not publish, create, sell, control, offer, deliver, or supply any guided tour. We are not a travel agency or a tour operator, and we do not provide tours ourselves. When you make a booking, you are entering into a contract directly with an independent tour guide. In no event shall OneDayLocal be deemed a party to any agreement whereby you book a guided tour from an independent tour guide. The independent tour guides, and not OneDayLocal, are responsible for the tours they publish and for their guiding services. You understand, acknowledge and agree that all the Guides are independent contractors and not employees, agents, joint venturers or partners of OneDayLocal, and that the Guides act exclusively on their behalf and for their own benefit, and not on behalf, or for the benefit, of Onedaylocal.
2.Acceptance of Terms of Use.
Any use of our website and/or services, as a website visitor, a guest or a host, constitutes an agreement to all terms and conditions and warrants that users understand, agree to and accept all terms and conditions contained here.
Suppliers on the platform are in compliance with the Onedaylocal code of conduct and byuers using our platform and booking our services are required to respect the Onedaylocal code of conduct.
3.Code of conduct for Onedaylocal Byers and Onedaylocal suppliers.
OneDayLocal connects guests to local hosts in Athens, offers genuine experiences and builds bridges between cultures.
To ensure the connections created are mutually beneficial and respectful, any usage of the OneDayLocal platform must be in line with our Code of Conduct by which buyers agree:
a) To respect the professionalism of their local host
b) To not behave in an offensive, aggressive, threatening, harassing, racist or xenophobic nature, or with sexual connotations, inciting violence, discrimination or hatred towards their local host and surrounding people
c) To not to try to bypass the online booking system of the Platform and arrange a tour without booking it on the platform
d) To not contact a Onedaylocal host for a purpose other than:
– Arranging details of the booking for a Onedaylocal experience;
– Arranging details of the meeting with the host;
– Asking for local tips & advice
e)To respect local customs and rules & regulations.
OneDayLocal reserves the right to refuse any person from participation in a tour, for whatever reason, in its absolute discretion, whether or not they have previously purchased a ticket. A person will be reimbursed for tickets previously purchased should they be refused permission to participate on grounds other than those set out above.
Code of Conduct for OneDayLocal suppliers.
OneDayLocal suppliers are expected to adhere to and respect the OneDayLocal suppliers Code of Conduct. The OneDayLocal Code of Conduct contains quality standards as well as basic requirements for hosting.

Host quality at OneDayLocal is defined by the following standards:
Passion
Passionate hosts are the heart of OneDayLocal. Our promise to travelers is to offer them a unique experience, led by hosts that are passionate about the topic of the experience, have a personal connection to it, and deep knowledge of it.
As a host, you are expected to communicate this passion with your guests:
Know your topics in depth, extra research and preparation work can make a world of difference.Be fully present during the experience, for example avoid getting distracted by your mobile.Be open and reactive to the feedback you receive from guests and Onedaylocal.
Connection
Connecting cultures and people is our mission. Connect with your guests at all the steps of their OneDayLocal journey.
Before meeting the guests:
Be available to reassure your guests and answer their questions. They might need some extra information, or simply reassurance that they picked the right host and experience.If any changes are necessary on the route or plan for the experience, communicate it clearly to your guests. Make sure that they are comfortable with the changes.
During the experience:
Pay attention to your guests’; needs: specific groups (elderly, children, persons with disabilities) may need special care.Face your guests and make pauses when giving an explanation to make sure everyone in the group feels involved and engaged.Be mindful of cultural differences, remember that different people may expect different behaviors and have different sensitivities. Remain curious and keep an open mind.
After the experience:
Following up on the experience and sharing extra information and tips with the guests can go a long way!
Not meeting these standards will result in an incompatibility to work as a OneDayLocal supplier. If you need any extra support or coaching, we are here for you!
Professionalism
Hosts are required to respect the following professional standards:
Being available and reachable by both the guests and the office, in particular for any urgent or time sensitive issue, and around the time of a booking.Having an appropriate and professional presentation and outfit, respecting hygiene standards.Communicating with guests and Onedaylocal in a polite and respectful manner.Respecting the commitment that is a booking. Unforeseen situations can of course happen, but being late, cancelling or not showing up to a booking without informing your guests and without a valid reason is not acceptable.Avoiding any inappropriate behaviour such as smoking during a tour.
Safety
Suppliers commit to maintaining high standards of safety and security when providing a service to guests. The following standards apply:
Onedaylocal suppliers should always avoid unsafe situations and assess tour activities for potential hazards or critical points. Informing guests of relevant safety procedures when necessary, keeping the relevant emergency numbers and being aware of the closest medical facilities is a must.Hosts must never be intoxicated on a tour/experience. Drinking alcohol is forbidden if wine or beer tastings are not included in the tour for guests (for example, Wine & Tapas tour).
In addition, hosts commit to never purchasing an alcoholic drink for a minor.Possession or use of illegal drugs on tour will result in instant removal from ObeDayLocal platform. Emotional or intimate involvement with any guest – whether real or perceived, and as assessed by Onedaylocal in its sole discretion, will lead to the instant removal from the platform. Onedaylocal suppliers are in a position of trust and are expected to act accordingly at all times while on a tour.
Hosts should never enter guests’ hotel rooms to avoid any possible misunderstandings.
We provide services to our hosts and therefore we treat the host as our legal customer. We will invoice the host. On this invoice we will state our details, any applicable taxes and details of the service(s) provided by the host to the traveler. As a host you are responsible for providing the traveler with any documentation and/or invoice needed in compliance with the applicable tax law(s).
It’s a host’s sole responsibility to determine which taxes are applicable and required to comply with the applicable local tax law and pay any corresponding taxes. These taxes can include, but are not limited to, taxes such as value added taxes, surcharges, sales taxes, personal or corporate income taxes imposed or any other taxes which are levied upon reservations made through our website or the payment thereof. Hosts represent and warrant that they will pay such taxes in time and in compliance with the applicable tax law.
4.Liability.
OneDayLocal’ responsibility is limited to facilitating the availability of our website, application and services. The participation in any of the events hosted by the hosts is at buyers’ own risk.In no event shall OnedayLocal be liable for any indirect, special, incidental or consequential damages of any kind, whether in an action of negligence or other tortious actions resulting from or arising out of participation in any of the events hosted by the hosts. OneDayLocal does not include personal insurance with its services. OneDayLocal recommends that customers purchase individually their own travel insurance (or ask their travel agent). We advise that you check your insurance contract in order to determine whether you are covered and to clarify what your travel insurance covers in the case of trips abroad. OneDayLocal will not be held liable for services provided by 3rd parties. You understand, acknowledge and agree that all the suppliers are independent contractors and not employees or partners of OneDayLocal , and that the suppliers act exclusively on their behalf and for their own benefit, and not on behalf, or for the benefit, of Onedaylocal.
The Guides,are responsible for determining, understanding and complying with all laws, rules and regulations that apply to their activity and to the Tours provided to
You.OneDayLocal DOES NOT TAKE ANY RESPONSIBILITY AND IS NOT LIABLE FOR, AND THE GUIDE IS SOLELY AND EXCLUSIVELY RESPONSIBLE FOR, ANY DIRECT, INDIRECT, PUNITIVE, INCIDENTAL, SPECIAL, EXEMPLARY, CONSEQUENTIAL OR ANY OTHER DAMAGES OR EXPENSES, ARISING OUT OF, OR IN CONNECTION WITH, WITHOUT LIMITATION, (I) THE DELIVERY OF ANY TOUR, (II) THE PERFORMANCE OF THE GUIDE OR FAILURE TO PERFORM THE TOUR AND/OR THE GUIDE’S SERVICES, (III) ANY TRANSPORTATION SERVICE ASSOCIATED TO ANY TOUR, (IV) ANY OTHER SERVICE OFFERED OR DELIVERED BY THE GUIDE, (V) THE GUIDE’S ACTS OR OMISSIONS, REPRESENTATIONS, WARRANTIES, NEGLIGENCE, GROSS NEGLIGENCE OR WILFUL MISCONDUCT AND (IV) PERSONAL, BODILY INJURY, DEATH, PROPERTY DAMAGE TO YOU, THE GUIDE OR ANY OTHER PARTY. OneDayLocal's RESPONSIBILITY IS LIMITED TO LISTING AND MAKING AVAILABLE THE TOURS AND OTHER ANCILLARY SERVICES THROUGH THE SITE.
5.Suppliers Release of Liability towards Byers.
By virtue of purchasing tickets for and/or participating in any of the tours advertised on Onedaylocal platform , and in consideration of being allowed to purchase said tickets, and for other goods and valuable consideration, the receipt and sufficiency of which is acknowledged, said purchaser/tour participant (if he/she not yet 18 years old, his/her parents or legal guardian) (the “Participant”) understand, acknowledges represents, warrants and agrees as follows, with the knowledge that suppliers will rely on same:
Participant desires to participate in the tours offered by the suppliers (the “Programs”).Participant is in good health and suffers from no minor or serious physical or mental injury, illness or disability that would make Participant especially susceptible to injury or disability while performing any activities related to or in connection with the
Programs.The participant fully comprehends and accepts each and every one of the risks associated with his/her participation in the Programmes including, without limitation, exposure to unfavorable weather conditions, food sickness, allergic reactions, choking, injuries, COVID-19 (e.g. without limitation, those arising out of self-inflicted accidents or mishaps, other participants, automobiles, pedestrians, bicyclists and the like) and death.Participation in the Programs is at Participant’s own sole risk. Participant, on behalf of his/herself and/or any person or entity acting through or on behalf of the participant, hereby forever and unconditionally releases Suppliers, from any and all claims, actions, damages, liabilities, losses, costs and expenses (including, without limitation, attorney’s fees) in any way arising out of, or resulting from, Participant’s participation in the Programmes, including, without limitation, any and all claims, actions, and liabilities for death, COVID-19 infection, injury, loss or damage to participant, to anyone else, or to any property, regardless of whether or not such injury, loss or damage was caused by the negligence or willful conduct of the company or any of the release parties. Participant’s release includes, but is not limited to, harm that may be attributable to, or in any way arise from, Participant’s own conduct, behavior, or history of pre-existing conditions or dispositions. Participant also agrees that Participant is financially responsible for any and all medical treatment required as a result of any such harm. Participant, on behalf of his/herself and/or any person or entity acting through or on behalf of the participant, further agrees to defend and indemnify the released parties, and to hold the released parties harmless, from any and all liabilities, claims, actions, damages, expenses (including, without limitation attorney’s fees) and losses of any kind or nature whatsoever in any way arising out of, or resulting from, Participant’s participation in the Programs.Participant agrees to pay any and all costs, fees, expenses and charges arising from any act or conduct of Participant that results in damage or injury to any person. Participant further agrees to indemnify and hold Suppliers harmless from and against any such act or conduct.This Waiver and Release of Claims constitutes the entire agreement and understanding between Participant and the suppliers, and cancels, terminates and supersedes any prior agreement or understand relating to the subject matter hereof. There are not representations, promises, agreements, warranties, covenants, or undertakings other than those contained in this Waiver and Release of Claims.
6.Warranties & Disclaimer.
OneDayLocal does not warrant that this website and/or our services will be uninterrupted or error-free. It may correct, modify, amend, enhance, improve and make any other changes to the website and services at any time or discontinue displaying or providing any content or features without a notice to any user.
We do our very best to make sure all the information we provide you is 100% correct. However, as we are human being too, errors are made.
We hereby disclaim all warranties and conditions with regard to the use of our website and/or services, including, but not limited to the availability, reliability, or quality of our website and services, the events distributed through us, including the nature and quality of the events, and is not and shall not be responsible for any error, fault or mistake of any and all content and information received through our users , including by hosts or travelers. We do not endorse any entity, product or service mentioned in any user generated content available on our website. OneDayLocal reserves the right to add, withdraw, substitute and/or vary advertised routes, prices and departure times for any of the tours advertized without notice. However, reasonable effort will be made to maintain arrangements as advertised.All prices provided for join-in tours are on a per person basis unless otherwise mentioned and include local taxes.Prices of the tours provided by the suppliers do not include tips, personal expenses, or travel insurance. If in doubt whether something is included in the price of the Program, please inquire.
7.Intellectual property.
The Site is protected by copyright, trademark, and/or other laws. All trademarks and logos used on or in connection with the Site are trademarks or registered trademarks of Onedaylocal.
You acknowledge and agree that the Site and all its components, texts, graphics, data, designs, look and feel, photographs, sounds, images, software, videos, and other content, including all associated intellectual property rights (“Proprietary Material”), are the exclusive property of OneDayLocal and/or its licensors or authorizing third-parties, and is protected in all forms, media and technologies. You may not copy, download, use, edit or retransmit any Proprietary Material, in whole or in part, without the prior written permission of Onedaylocal.
8.Terms of payment
You pay us partly ( 50% of the full amount)or the full amount beforehand. Depending on your payment, the remaining amount has to be paid to the host directly after a satisfactory experience.
Full payment in advance:
When making a reservation, it is possible you have to pay the full amount in advance. In this case you pay us the full amount stated on the website which is paid to the host, within 72 hours after the reserved event has taken place in a satisfactory manner, while deducting the Onedaylocal fee payable by the host. As a traveler no additional payments are needed; when the reservation is confirmed by us, all payments are done.
Partial payment in advance:
In some cases, you will be asked to pay 50% of the full amount upfront, as stated on our website. In this case, the remaining unpaid share( the other 50% of the full amount) has to be paid by the traveler to the host directly after the reserved event has taken place in a satisfactory manner.
In case of a full payment in advance, OneDaLocal will facilitate the payment as a commercial agent on behalf of the host. Therefore, by accepting this Terms & Conditions, the host enters into an agreement with OneDayLocal determining that OneDayLocal is authorized to negotiate or conclude the sale of the services provided by the host on behalf of the host.
9.Cancellation policy.
Cancelling a confirmed booking
Once a guest books an experience on OneDayLocal he has a 24-hour window after the booking request is sent out to cancel their booking without any penalty.
In ever tour in section “Useful info”, you can see all the time limits , that if the guest cancels a tour within the time period described from tour beginning time, the guest will receive a 100% refund.
If an experience is canceled by the host, the guest will receive a 100% refund.
*This takes into account the starting time of the tour in the time zone of the experience.
Same day bookings
If the booking was made for the same day, meaning the starting time is within 24 hours no refunds apply.
Cancelling an unconfirmed booking
All bookings on request need to be confirmed by the host within 48 hours. If you cancel an unconfirmed booking within 48 hours, you will receive a full refund.
Please note that buyers receive no refunds if they don't cancel the tour and they do not show within 1hour from tour beginning time.If a guest does not show up at the tour because of an “unforeseeable event” out of his control , he gets a full refund. The determination of what constitutes Unforeseeable Events is at the discretion of Onedaylocal.
The following is a list of examples of what we consider as Unforeseeable Events:
(a) Impersonal events that make it dangerous or impossible to safely undertake a tour, such as: travel restrictions imposed by governments, epidemic disease unusual to an area, war, civil insurrection, strike, extreme weather, earthquake and natural disaster;
(b) A ship that is unable to dock and prevents You from taking a tour identified and marked as a shore excursion tour type on the site;
(c) A flight cancellation if there are no other means to travel to the destination; and
(d) A “Do Not Travel” advisory issued by the US Department of State after a booking is made.
The following do not constitute Unforeseeable Events:
(a) Illness or injury of a tour participant;
(b) Poor weather;
(c) Change of plans;
(d) Oversleeping.
We may require You to provide verification and/or documentation to confirm that You were unable to take your tour if You request a refund under this provision.
All cancellations must be initiated by contacting Onedaylocal via email or telephone.
10.JURISDICTION& APPLICABLE LAW
Those who choose to access this website do so at their own risk and on their own initiative and are responsible for compliance with all applicable local laws. These terms shall be governed by and construed in accordance with the Greek Government Laws. Any dispute under these terms shall be subject to the exclusive jurisdiction of the courts of Athens, by using this website, you hereby submit to the jurisdiction of such courts for such purposes and waive any and all objections as to jurisdiction or venue in such courts.
